TKE Plus — Terms of Service

1. Who We Are
These Terms of Service ("Terms") govern your use of TKE Plus services, including TKE Plus monthly IT support coverage and one-off break/fix help, and your use of the website https://tkeplus.com.
Operator: William L. Cutburth, doing business as Tech-Knowledge-E. TKE Plus is the name of the service.

2. Services
We offer IT support for small businesses:
- TKE Plus monthly coverage: ongoing monthly IT support coverage.
- One-off break/fix help: non-subscription work, as quoted.
Service area: we provide on-site service in Osawatomie and Miami County, Kansas, and remote support everywhere.
The exact scope of any engagement is defined in quotes, statements of work, tickets, or other written agreements, not by these Terms alone.
3. Eligibility
Services are intended for businesses and adults. We do not target children under 13.
By engaging us, you represent that you are authorized to bind the business (if acting for an entity) and that you are of legal age to enter contracts.
4. Quotes & Scope
Quotes, estimates, tickets, and written agreements define the scope of work. Work outside the quoted scope may require a new quote or written change approval.
These Terms do not promise specific response times or uptime. Any such commitment, if offered, must be stated in a separate written agreement.
5. Pricing & Payment
Pricing is by quote. Please call 913.378.7191 for pricing. The price will be confirmed with you before work starts.
Payment methods will be stated in your quote or invoice.
You agree to provide accurate billing information and to pay amounts due as agreed in writing.
6. Cancellation of Subscription
You may cancel the TKE Plus subscription by contacting us by phone or mail.

7. On-Site Access & Customer Responsibilities
For on-site work, you agree to provide reasonable, safe access to premises, equipment, accounts, and information needed to perform the agreed services.
You are responsible for:
- An accurate description of issues and your environment
- Backups of critical data (unless backup is expressly in scope and quoted)
- Authority to grant access to systems and premises
- Compliance with your own policies and third-party license terms
Remote access: you authorize remote connection methods as agreed for support.
8. No Guarantee of Fix
Technology issues vary. We will use commercially reasonable efforts consistent with the agreed scope, but we do not guarantee that every issue can be fixed, that systems will be free of defects, or that any particular outcome will be achieved.
Hardware failure, third-party software, cloud provider outages, and pre-existing conditions may limit what is possible.
9. Intellectual Property
Each party retains intellectual property in materials it owned before the engagement.
Our trademarks and branding (Tech-Knowledge-E, TKE Plus) and the materials on tkeplus.com remain ours or our licensors'. You may not use our marks without prior written permission.
10. Acceptable Use
You agree not to use our services to:
- Violate law or third-party rights
- Request or facilitate unauthorized access to systems you do not control
- Store or transmit unlawful content through channels we provide
- Abuse support channels or interfere with service delivery to others
We may decline or suspend work that we reasonably believe violates this section or applicable law.
11. Customer Responsibilities and Backups
- You are responsible for keeping current backups of your data before and during any service, unless backup is expressly in scope and quoted.
- You must have the right to give us access to the devices, accounts, and systems you ask us to work on.
- You will provide accurate information and reasonable access.
- Unless backup is expressly in our quoted scope, we are not responsible for data loss that a current backup would have prevented.
12. Third-Party Products
- Hardware, software, and services from other companies are covered only by those companies' own warranties and terms.
- We do not provide those warranties.
13. Disclaimer of Warranties
- We provide services with reasonable care and skill.
- Except as stated in these terms, and to the extent the law allows, we make no other warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.
- We do not guarantee that systems will be error-free, uninterrupted, or secure from every threat.
14. Limitation of Liability
- To the extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business interruption.
- Our total liability for any claim related to the services is limited to the amount you paid us for the specific service that gave rise to the claim.
- For the TKE Plus subscription, that limit is the fees you paid in the 3 months before the claim.
- Nothing in these terms limits liability that cannot be limited by law.
15. Dispute Resolution
Before filing any claim, both parties will try in good faith to resolve the dispute informally, starting with you contacting us by phone or mail.
16. Governing Law
These Terms are governed by the laws of the State of Kansas.

18. Changes; Separate Business

Tech-Knowledge-E and TKE Plus are operated separately from any other business or brand. Do not assume shared terms, accounts, or liability with any other business.
